Re: 4Afugan Refugees and 2 Persons of Concern to UNHCR

Dear Mr. Kijima

I would like to refer to the following 5 cases of Afugan nationals: Mr. Abdullah Basir (DOB:6 November 1974) (4人の名はふせてある)

Let me start by reiterating UNHCR' long - standing position that most Afugan are in need of international protection, many of whom as Convention refugees and most of the rest as victims of civil war. In the latter case, they shoud not be deported or detained and rather being granted temporary permits to stay on hunanitarian grounds.

Regarding the above mentioned individuals, who have approched UNHCR for consideration of their refugee status, we understand that Mr.Basir's second applications are under review by your Section . Through this ietter, UNHCR would like to confirm our position over the cases.Mr.Basir (already conveyed by telephone in July 2001 and again in the above list in September 2001)

UNHCR considers Mr.Basir to have strong grounds for asylum for their political opinion. Each of them has demonstrated to our satisfaction that each held membership/activities to Hezbe-Wahadat, a major opposition group to the Taliban regime.

In Afganistan the controlling authority of Taliban has been known to resort to violence against the opposition groups including Hezbe-Wahadat. After the recent events in the country following the bombardment by the US forces, moreover, it is reported that the grave situation jn this country has only worsened with lawlessness prevailing in that country .The Taliban and its fighters are now scattered around the country and appear to be ofen operating without any central command.

For the above reasons, UNHCR would like to renew its recommendation on the above three for refugee status . We would like to request your Section to give favourable considerations to the above asylum seekers and to coordinate with other concerned Divisions of the Immigration Bureau in providing them with a solution in Japan.
